Terms and Conditions For App Store

Language and Governing Version: This English-language Terms and Conditions document is the governing and legally controlling version. Any translation is provided for convenience/reference only. In case of conflict, ambiguity, or inconsistency, this English version prevails.

These Terms and Conditions ("Terms") govern your App Store purchase access, download, installation, support interactions, and related use of Work with Script distributed through the Apple App Store.

If you install or use the Software, the EULA also applies. If there is a conflict between these Terms and the EULA regarding software use, the EULA controls.

1. Provider

The software provider is Alexander Androsov, operating as an individual sole proprietor ("Provider", "I", "me", "my"), as identified in the App Store listing and official website/legal notice.

2. Eligibility

You must be legally able to enter into binding agreements in your jurisdiction. If you use the Software on behalf of an entity, you represent that you are authorized to bind that entity.

If you are under 18, you may use the Software only with legally valid parent/legal guardian consent.

For users in Germany, legal capacity rules under the German Civil Code (BGB), including legal incapacity, limited legal capacity, and section 110 BGB where applicable, remain fully applicable.

3. Product Model (App Store Channel)

1. Work with Script is licensed software, not sold.
2. Access and installation through the App Store are governed by Apple's platform terms in addition to these Terms and the EULA.
3. Where Apple platform rules are mandatory and conflict with a purchase-flow detail in these Terms, Apple's platform rules control for App Store transactions.

4. Orders, Pricing, Billing, and Taxes

1. Prices are shown in the App Store and may change for future purchases.
2. Payment processing, billing, tax handling, and refunds for App Store transactions are handled by Apple under Apple's applicable platform terms and policies.
3. I do not control Apple's payment processing or refund workflows for App Store purchases.

5. Delivery and Activation

1. Delivery is digital through the App Store.
2. App Store entitlement and installation are managed via your Apple account and device ecosystem according to Apple terms.
3. You must not attempt to bypass platform controls, security checks, or licensing mechanisms.

6. Storefront-Specific Licensing and Website Trial/Lite

1. The App Store version is a distinct distribution channel.
2. Any 7-day trial/lite version offered on my official website, alexanderandrosov.com, is a separate distribution channel and may be governed by separate terms, entitlement rules, and technical limits.
3. App Store entitlement does not automatically include website trial/lite or direct-download entitlements, and website trial/lite entitlement does not automatically include App Store entitlement.

7. Acceptable Use

You agree not to:

1. redistribute, resell, sublicense, rent, lease, lend, or otherwise repackage/make available the Software without written permission;
2. tamper with security controls, anti-abuse protections, activation/entitlement checks, or protected binaries;
3. use unauthorized, modified, or cracked builds;
4. use the Software in violation of law or third-party rights.

8. Intellectual Property

All rights in the Software and branding remain with me and my licensors. Third-party components remain owned by their respective rights holders and are governed by their own license terms.

9. User Content

You retain ownership of content you create with the Software (for example scripts, notes, sheets, music, and exports). You are responsible for legality and rights clearance of your content.

I do not use your User Content to train or fine-tune AI/ML models unless you separately and explicitly opt in.

10. Feedback and Suggestions

If you submit feedback, suggestions, feature ideas, bug reports, or similar product input, you grant me a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use, adapt, modify, publish, and commercialize that input for software development and related business purposes, without payment, attribution, or additional approval obligations to you.

To reduce legal ambiguity, please do not submit feedback that is confidential or subject to third-party licensing terms that would restrict my ability to use it under this section.

11. Export Control and Sanctions

You represent that you are not located in, organized in, or ordinarily resident in a comprehensively sanctioned/embargoed region, are not on a prohibited-party list, and will not export, re-export, or use the Software in violation of applicable export control or sanctions laws.

12. Updates and Compatibility

I may provide updates, fixes, and improvements. I do not guarantee uninterrupted availability, compatibility with every OS/plugin setup, or support for all historical versions.

13. Suspension and Termination

I may suspend support or terminate license rights for serious or repeated violations of these Terms or the EULA, including fraud, piracy, tampering, or unlawful use.

14. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND EXCEPT WHERE SUCH WARRANTIES CANNOT BE EXCLUDED BY LAW.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF DATA/PROFITS/REVENUE.

MY TOTAL LIABILITY FOR CLAIMS RELATING TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT PAID FOR THE RELEVANT LICENSE.

Nothing in these Terms limits rights that cannot be limited under mandatory law.

16. Governing Law and Venue

These Terms are governed by the laws of the jurisdiction where I am established, unless mandatory local consumer law requires otherwise.

17. Changes to These Terms

I may update these Terms for legal, technical, or business reasons. Updated Terms apply to future interactions and, where legally permitted, to ongoing use after notice.
